I think this article is a bit late.

The process for dealing with the unauthorized use of IP is fairly clearly laid out in the DMCA law. That happened 10 years ago.

Companies are, for the most part, aware of the advantages and risks of allowing the "viral" use of their symbols. And they make decisions on a case by case or company by company basis.

If you are doing some fan activity, there isn't much to worry about, really. If a company objects to your use of a logo, you simply take it down when/if they ask you to. You only get sued if you persist after a request.

I don't think that infringing video is being pulled off YouTube because lawyers are salivating over Google's deep pockets while the independent old YouTube was immune via poverty. In the past, infringing video slipped by because IP owners weren't paying attention. Now, companies like YouTube find it easier to just pull content at the first request than to even think about whether the request is valid, much less fight.

Yes, I see your point--and I agree--and I also hope that companies will be more creative (muse: social media interactive?) with their IP/logo/branding to support the fans that support them. Capitalism + Hive Mind=business opportunity?

I concur with theme. Who has the resources for enforcement? Although perhaps those can be paid for with the stiff infringement fines. :-)
